Do you know that compensation is not payable in respect of incapacity or death of an employee if the incapacity begins or the death happens more than 12 months after the employee has ceased to be employed by the employer from whom the compensation is claimed, but if the incubation period of the disease is more than twelve months, that period shall be taken into account, except where the death of an employee has been preceded by a period of incapacity due to the disease causing the death in respect of which the employer is liable. Section 31 (4) of Workmen’s Compensation Act, 1987 P.N.D.C.L. 187
